Strengthening Legal-Criminal Protection of an Individual's Privacy on the Internet

Law n.º 44/2018 of 9 August amended articles 152 and 197 of the Criminal Code and reinforced the importance of respect for an individual's privacy.

In relation to the crime of domestic violence, a person who practices physical abuse against another person and disseminates, through the Internet or other means of general public dissemination, personal data, such as images or sounds, relating to the private life of one of the victims without his/her consent, shall be punished by imprisonment of two to five years.

With regard to crimes against privacy, a person who commits any of the crimes set out in articles 190 to 195 of the Criminal Code (violation of domicile or disturbance of privacy, introduction in a place prohibited to the public, privacy intrusion, computer misuse, breach of correspondence or telecommunications and breach of secrecy) through the Internet or other means of widespread public dissemination is subject to a penalty increase by one third in its minimum and maximum limits.

Law n.º. 44/2018 of 9 August came into force on 1 September 2018.
